1. Overview

This Acceptable Use Policy (“AUP”) sets out the rules for using the Xirvy website and the Xirvy Shopify application (together, the “Services”). It supplements and forms part of our Terms of Service. Capitalised terms not defined here have the meaning given in the Terms of Service.

By accessing or using the Services, you agree to this AUP. If you use the Services on behalf of a business, you confirm you have authority to accept this AUP for that business.

2. General conduct

You must not use the Services to, or in any way that would:

  • Break any applicable law or regulation, including consumer protection, advertising, pricing, tax, competition, sanctions, or export laws
  • Infringe the intellectual property, privacy, publicity, or other rights of any person
  • Deceive, defraud, or mislead any person, including your own end customers
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Interfere with any other customer’s use of the Services or the operation of Shopify

3. Prohibited content and activities

You must not use the Services in connection with content or activities that:

  • Are unlawful, defamatory, obscene, hateful, or harassing, or that promote violence or discrimination
  • Involve the sale of goods or services that are illegal or prohibited by Shopify’s policies
  • Contain malware, viruses, or other harmful code
  • Constitute unsolicited or unauthorised advertising, spam, or bulk messaging in breach of PECR or similar laws
  • Exploit or harm minors, or attempt to collect data from children in breach of law

4. Storefront and offer conduct

Because Xirvy helps you create discounts, upsells, and promotional offers, you must ensure that your use of these features is fair and lawful. In particular, you must not:

  • Display false, misleading, or unsubstantiated reference prices, “was/now” prices, savings, or discount percentages
  • Advertise offers, stock levels, urgency, or scarcity that are not genuine
  • Apply terms to an offer that are not clearly and accurately disclosed to the customer before purchase
  • Use countdowns or promotional messaging in a way that pressures customers through inaccurate information
  • Configure offers that breach the UK Digital Markets, Competition and Consumers Act, the Consumer Protection from Unfair Trading Regulations, or equivalent laws in your market

You are solely responsible for the accuracy and legality of all pricing, offers, and messaging shown to your customers.

5. Security and system integrity

You must not:

  • Attempt to gain unauthorised access to the Services, related systems, or another user’s data
  • Probe, scan, or test the vulnerability of the Services, or breach any security or authentication measures, except under a program we authorise in writing
  • Interfere with, disrupt, or place undue load on the Services or supporting infrastructure (including denial-of-service activity)
  • Reverse engineer, decompile, or disassemble the Services except to the extent this restriction is prohibited by mandatory law
  • Scrape, harvest, or use automated means to extract data from the Services except via functionality we provide or otherwise permit in writing
  • Circumvent usage limits, billing, or access controls

6. Data and privacy obligations

When you use the Services you must comply with all applicable data protection laws, including UK GDPR, the Data Protection Act 2018, and PECR. You must provide your end customers with all required privacy notices and obtain any consents needed for your storefront, cookies, and marketing. Where we process personal data on your behalf, that processing is governed by our Data Processing Agreement.

7. Enforcement and suspension

We may investigate suspected breaches of this AUP. Where we reasonably believe a breach has occurred, or where required by law or by Shopify, we may take action proportionate to the issue, including:

  • Issuing a warning and requesting that you remedy the breach
  • Removing or disabling access to offending configuration or content
  • Suspending or restricting your access to the Services
  • Terminating your access and, where appropriate, reporting the matter to Shopify or the relevant authorities

Where practicable and lawful, we will give notice before taking action, but we may act immediately where there is a risk to security, legal compliance, or other users.

8. Reporting abuse

If you become aware of any use of the Services that breaches this AUP, or of a security vulnerability, please report it to the email address in Contact with enough detail for us to investigate. Please do not publicly disclose a suspected vulnerability before we have had a reasonable opportunity to respond.

9. Changes to this policy

We may update this AUP from time to time. The “Last updated” date above will change when we do. Continued use of the Services after changes take effect constitutes acceptance of the updated policy.
